What is Service of Process?
Service of process refers to the act of delivering legal documents to people to notify them of actions that are taken against them in a court of law. People are notified of court procedures or of actions against them through documents such as summons, complaints, subpoenas and more.
Do the Laws Differ by State?
Yes.
Each state has its own set of laws that govern service of process. As a result, it is important to ensure the service processor is familiar with the specific legislation in the area of service.
Can Anyone Serve Papers?
NO.
The laws differ from state to state. So, some states require process servers to be licensed, others require registration with the county, and others are required to post a surety bond. In St. Louis City, all servers must have a city issued process servers license. Also, in Illinois, process servers are required to be licensed or appointed.
What Does a Legal Processor Do?
A legal process server delivers legal documents in accordance to the legislation in the area of service.
How Long Does the Process Take?
